Description

The Mortgage Certificate is the document containing registrations, transcriptions and notes on properties or on natural/legal persons;

What does the mortgage certificate contain?

The data contained in the mortgage certificate have legal value and are:

  • Transcriptions: real estate sales contracts, mediation agreements, transaction agreements, contracts and sentences which constitute the transfer or modification of real rights of enjoyment;
  • Registrations: legal, voluntary and judicial mortgages.
  • Annotations: Edits of previous transcriptions, inscriptions, and annotations.

ATTENTION: The mortgage certificate on the property does not contain the names of the owners

If you want to know the content of each formality, you may be asked to develop a single note. The development of each single note reports the general register number, the particular register number, the year and the province. All this information is indicated in the summary of the Mortgage Certificate.

It is necessary to specify that the data in the mortgage certificate are updated on the date on which the registrars began archiving on computer media.

The mortgage certificate can be requested on:

  • subject (natural or legal persons) and contains registrations, transcriptions and notes relating to the subject in question;
  • on property (land or building) and contains inscriptions, transcriptions and notes on property, land or building.

The formalities resulting in the mortgage search are those recorded in the public real estate registers.

To request a mortgage certificate for a property, land or building, you must fill out the form by entering the following information:
  • the Municipality of the property (land or building);
  • the property sheet (land or building);
  • the parcel of property (land or building).

If you request a mortgage certificate on buildings, you must also know, if there is one, the sub or subordinate of the building;

To request a mortgage certificate on a natural person, you must complete the form by entering the following information:

  • name of the natural person;
  • surname of the natural person;
  • tax code of the natural person.

If you request a mortgage certificate on a legal entity, you must also enter the tax code or VAT number.

NB it cannot be requested in the provinces in which the land register system is in force. (Trento, Bolzano, Trieste and Gorizia)

When to request a mortgage survey

Requesting a mortgage certificate is useful:

  • if you want to know if there are encumbrances on a property (mortgages, foreclosures, etc.);
  • if you want to know if a debtor is the owner of assets that can be attacked;
  • if you want to know if there has been a sale or donation on a property;
  • if you want to know the patrimonial consistency of a physical or legal entity;
  • if you want to know if there is more than one co-ownership of shares on a piece of land or building.
